honour of Earl of Crawfoord by two Titles. 1^st By the Tailzie
as written The Said honour and Dignity returns to him by
The Tailzier of heirs Male of the Said Davids Body 2^ly Al-
though there had been no Tailzie of that Nature yet he is
nearest heir Male to this Said David Earl of Crawfoord who
disponed the Estate to the Laird of Edzell his predecessor:
And he is nearest heir to Lodowick Earl of Crawfoord And to
the Lord Spynie who were the Last heirs Male of the Said
David Earl of Crawfurds Body And as nearest heir Male to them
he hath also undoubted Right to the Said Title of honour.

BUT The Said Lodowick Earl of Crawfoord being unjustly
forfault for his Serving the Kings Majestys father in England
in his Wars The Deceast John Earl of Lindsay upon that
forfaulture Did Assume and take upon him the Title and
Dignity of Earl of Crawfoord, And which he and William
now Earl of Lindsay his Son hathever Since possest wrong-
ously Notwithstanding the Same doth Rightously belong to
the Laird of Edzell, As said is.

WHEREUPON the Said Laird of Edzell doth now Insist before
the Parliament Against the Said William Earl of Lindsay for
having it found And Declared That the Said Laird of Edzell
hath the only Right to the Title of Honour and Dignity of
Earl of Crawfoord And that the Said Earl of Lindsay hath no
Right thereto And that the foreSaid Decreet of Forfaulture
of the Said Lodowick Earl of Crawfoord And other grounds
whereby the Said William Earl of Lindsay pretends Right to
the Said Title of Honour may be reduced.

IT WAS Alledged for the Earl of Lindsay That the Disposi-
tion from David Earl of Crawfurd to the Laird of Edzell In
Anno 1541 Is only Certain Lands without mentioning the
Title and Dignity, And, Therefore it was an Usurpation that
fore Some few Years Edzell designed himself Earl of Crawfoord
In the Minority of the Earl of Crawfoord Oye And when he
came to be Major he retrocessed him to the Estate And quhil
the Title and Documents that are produced for Edzell to
Instruct that his predecessor was Earl of Crawfoord Such a
Summons to the Parliament and others were not to Edzells
predecessor whose name was likeways David But they related
to David Earl of Crawfoord who disponed to Edzell or to
